Selibon Media attaches great importance to the privacy of its visitors and users. Accordingly, in this Privacy Policy ("Privacy Policy"), Selibon Medya A.Ş. , together with its subsidiaries all over the world . Company (" Selibon Medya ", "we", "our", "us" or "us") collects, uses and shares your Personal Data, as well as the rights you have on the Personal Data as the relevant person. 2. What Personal Data do we collect?
Main Agency: In this agreement, the term “Main Agency” refers to Selibon Media Planning and Consulting Inc.
Sub-Agency: In this agreement, the term “Sub-Agency” refers to the legal or real person who establishes a cooperation relationship with the Main Agency within the scope of this agreement.
Publisher: In this agreement, the term “Publisher” refers to the person who carries out content production activities by establishing a contractual relationship with the Main Agency or Sub-Agency.
SeliPay: This is the system created by Selibon Media, which handles the performance scoring, entitlement and payment processes of publishers.
Backstage: TikTok's Official admin panel where agency health score, revenues and publisher performance metrics are tracked.
Valid Go Live Ratio: It refers to the ratio of valid live broadcasts opened by broadcasters according to the specified criteria to the total number of broadcasters.
Graduate: This refers to a streamer who has not previously exceeded the 100,000 diamond threshold and has reached 100,000 diamond earnings for the first time.
Activity Revenues: Revenues obtained from broadcasters' on-platform tasks and live broadcast activities.
Reference Award: This refers to the SeliPay award determined by Selibon Medya in accordance with current conditions for new publishers who join the agency by applying through the personalized reference link provided through the Main Agency systems.
Purchase Quota: It refers to the upper limit of the number of publishers that Sub-Agencies can accept within the framework of the determined performance criteria.

3. How do we use this Personal Data?

This agreement has been prepared to regulate and oversee the activities of Sub-Agencies within the scope of Selibon Media's (Main Agency) publisher management system and to define the rights and obligations of the parties. This agreement governs the Sub-Agencies' collaboration process with the Main Agency, publishers' transfer and exit rights between agencies, entitlement and payment procedures, performance and growth criteria, purchasing quotas and graduation requirements, managers' income entitlement ratios, debt transfer provisions, award cost allocation, confidentiality and non-competition, protection of brand value and corporate identity, publishers' readmission requirements, liability and compensation obligations, force majeure situations, dispute resolution methods, and general provisions.

4. How do we share your Personal Data?

4.1. Marka Değeri ve Kurumsal Kimlik Koruması

Selibon Medya’nın marka değeri ve kurumsal kimliği, Ana Ajans’ın en önemli varlıklarından biridir. Alt Ajanslar, bu değeri korumak, geliştirmek ve her türlü zarar ihtimalinden uzak tutmakla yükümlüdür.

Alt Ajanslar, Selibon Medya’nın marka değerini, kurumsal itibarını veya iş ilişkilerini zedeleyebilecek her türlü söz, davranış ve uygulamadan kesin surette kaçınmakla yükümlüdür.

4.2. Performans, Kota ve Büyüme Beklentileri

Alt Ajansların performansı; Geçerli Go Live Oranı, mezuniyet sayısı ve aylık büyüme kriterleri esas alınarak değerlendirilir.

Geçerli Go Live Oranı: Alt Ajansların Geçerli Go Live Oranı en az %50 olmalıdır. Oran %50’nin altına düştüğü takdirde Alt Ajansın alım kotası takip eden ayda yarıya düşürülür.

Mezuniyet: Alt Ajansların her ay en az iki (2) yayıncıyı mezun etmesi beklenir. Bu ek %25 hakkediş almasını sağlar. Ayrıca her mezun ana ajanstan yayıncı alım kotası kazandırır.

Büyüme Kriteri: Aylık performansta, bir önceki aya kıyasla en az %20 oranında elmas kotası artışı sağlamalıdır. Bu ek %25 hakkediş almasını sağlar.

5. Where do we store your Personal Data?
The Sub-Agency is obliged to comply with the written and/or approved procedures determined by the Main Agency in the recruitment, departure or participation of publishers in special campaigns.
Any advertising, campaign, announcement or promotional activity carried out by the Sub-Agency is subject to the prior written approval of the Main Agency.
The Sub-Agency is responsible for preparing regular reports within the scope of its activities and submitting these reports to the Main Agency.
The Sub-Agency acknowledges that it is open to the supervision and control of the Main Agency in all its operations.

We may store and process Personal Data in the United States, Europe, Israel and other jurisdictions, either ourselves or with the help of our affiliates and service providers.
Selibon Media's data storage providers have undertaken to protect your data in accordance with the contractual provisions. Selibon Media will ensure, among other things, that an adequate level of protection or relevant Standard Contractual Clauses are in place for the international transfer of our EU users' data.
6. Personal Data of End Users
All financial transactions and entitlement processes of Sub-Agencies are subject to the procedures and principles set forth in this agreement. The Sub-Agency agrees and undertakes to act in accordance with these procedures and principles.
The principles of transparency, accountability and record keeping are observed in the arrangement of payments and entitlements.
Without the written approval of the Main Agency, the Sub-Agency cannot assign a different payment method to itself or its publishers.
6.1. Sub-Agency Entitlement Calculation
The income entitlement of the Sub-Agency manager is determined based on performance criteria.
Calculation Method: The net amount remaining after deducting the publishers' SeliPay entitlements from all income obtained from the active duties of all publishers within the Sub-Agency is considered as the income entitlement of the Sub-Agency.
Activity earnings increase with the number of LIVE broadcast days and duration of the LIVE broadcast. The income rates from activity tasks are as follows.
(There are 5 Levels and the rates can only be mentioned in the contract.)Each of the following criteria determines the percentage of the Sub-Agency's revenue entitlement. If all criteria are met, the Sub-Agency's revenue entitlement will be 100%.
50% Income Entitlement: Full compliance with the basic rules.
Additional 25% Income Entitlement: The Sub-Agency must show at least 20% growth in the total number of diamonds purchased compared to the previous month.
Additional 25% Income Entitlement: Sub-Agency graduates at least 2 publishers every month.
All income obtained from reference awards is considered as an additional entitlement and is added to the Sub-Agency's receivables.
All SeliPay rewards earned through publishing activities are added to the Sub-Agency's receivables.
6.2. Financial Provisions
To receive cash payments, Sub-Agencies must either be incorporated or submit a valid exemption document. Cash payments will not be made until these conditions are met. However, they may use their earned income as SeliPay points.
Progress payments are made every 20,000 TL.
Payments are made via a cash withdrawal request created via the Selibon application and are made on the day and time of the appointment.
The Main Agency covers all reward costs, including leaderboard rewards, raffles, top streamer rewards, top subscription revenue earning rewards, and top stream duration rewards.
If a publisher within a Sub Agency wins a Platinum Member award, the cost of this award will be shared equally (fifty-fifty) between the Main Agency and the relevant Sub Agency.
A sub-agency that acquires a publisher that owes money to the Parent Agency is deemed to have acquired all of that publisher's existing debts. If the acquired publisher subsequently terminates its agency membership or ceases broadcasting activities entirely, the amount of the debt will be reflected in the Sub-agency's entitlement.

Selibon Medya may collect and process Personal Data of End Users.
We only do this on behalf of and at the direction of our users.
Our users are solely responsible for the Personal Data of End Users, including the legality, security and integrity of such Personal Data.
Selibon Medya has no direct relationship with any of the End Users. If you are an End User, please contact the owner of the relevant Selibon Media site directly.

We and our Third Party Service Providers use cookies and other similar technologies (“Cookies”) to provide our Services and ensure their proper functioning, to analyze our performance and marketing activities, and to personalize your experience.

8. Communications sent by Selibon Media
8.1. Promotional Messages:
We may use your Personal Data to send you promotional content and messages from Selibon Medya or our partners ( acting on behalf of Selibon Medya ) via e-mail, SMS, notifications on our platform, marketing calls and similar communication methods.
If you do not want to receive such promotional messages and calls, you can inform Selibon Medya at any time or follow the "unsubscribe" or STOP instructions included in the promotional messages you receive.
8.2. Service and Billing Messages:
Selibon Medya may also contact you to provide you with information regarding our Services or your use of our Services. For example, to notify you if a particular Service is temporarily suspended for maintenance, to respond to your support ticket or email, to send reminders or alerts regarding upcoming or overdue charges for your current or upcoming subscriptions, to submit complaints of improper use regarding your User Site, or to We may send you a notice (by any of the means available to us) to notify you of material changes.
It is important that you always receive these types of messages. Therefore, you may not opt out of receiving such Service and Billing Messages unless you cease being a Selibon Media User (which you may do by deactivating your account).

We may also contact you with messages and content regarding services and billing. You cannot choose not to receive these messages.
9. COPYRIGHT AND USE RIGHTS
All brand elements of Selibon Medya (name, logo, trade name, visual and corporate identity elements) may only be used with the written approval of Ana Agency and within the framework of its established procedures. Any unauthorized or misuse of these elements is strictly prohibited.
Alt Agency cannot license, transfer or allow the use of Selibon Medya's brands and content to third parties or organizations in any way.

You have the following rights in relation to the Personal Information you hold with us: to access, obtain a copy of, update, amend or delete your Personal Information, to benefit from data portability (in certain cases) to restrict or object to certain uses of your Personal Information, to withdraw your consent to us before processing.
Contact us by email, post or via our customer service team or, where available, fill out our dedicated form.
You may also correct and/or update your Personal Information through your user account, if you have one.
You can also delete your Personal Information by deleting your entire account. We will respond to your requests within a reasonable time.
10. Additional Information for California residents
Confidentiality Obligation: Alt Ajans is obligated to keep all strategies, systems, algorithms, publisher information, personal data, and other trade secrets belonging to Selibon Medya confidential. In this context, it acknowledges and undertakes to fully comply with the provisions of Personal Data Protection Law No. 6698 ("KVKK").
The Sub-Agency accepts and undertakes that, during the term of the contract and for twelve (12) months following the termination of the contract, it cannot cooperate with any agency or organization that directly or indirectly competes with Selibon Medya, it cannot provide consultancy to such an agency, and it cannot directly transfer publishers.
In the event of expiration or termination of the contract, the Sub-Agency agrees and undertakes to return all publisher data, documents and materials in its possession to the Main Agency or to destroy them irreversibly upon the request of the Main Agency.
